Food App (Staging)

Terms of Use

Last updated 4 October 2026

Draft — not for production use. Lawyer review is still required before these terms apply.

Status: Draft — not for production use. Lawyer review required before Phase 3 public launch. Legal entity, product name, and contact are founder fill-ins.

1. Who we are

2. Acceptance

By creating an account you must confirm that you agree to these Terms and the Privacy Policy. We record the document version and the time you accepted.

Existing accounts must accept the current versions before using the signed-in app when we publish an update. Reading `/terms` and `/privacy` does not itself count as acceptance.

The onboarding nutrition-disclaimer checkbox is not acceptance of these Terms or the Privacy Policy.

3. The service

Food App provides recipe storage, meal planning, shopping lists, and nutrition tracking for personal use. Nutrition estimates (including catalog foods, photo import, and photo macro estimates) are informational only and are not medical or dietetic advice.

Ingredient search and barcode lookup use local copies of public food datasets. The app does not call USDA or Open Food Facts over the network while you search.

Optional photo features send images to Google Gemini to extract a recipe draft or estimate macros. You choose when to use those features.

4. Your data

You retain ownership of content you enter. We store and process data as described in the Privacy Policy.

Household members can see shared recipes, the shared meal plan, and shared shopping lists. Your nutrition logs, settings, and biometrics stay yours.

5. Acceptable use

Use the service only for personal meal planning and nutrition tracking. Do not attempt to disrupt the service, access another person's account, or upload content you do not have the right to use.

(Draft — prohibited uses and account-sharing limits still need lawyer review.)

6. Availability

No uptime SLA in closed or public beta. Service provided as-is during beta.

7. Limitation of liability

(Draft — require lawyer review for AU consumer law)

8. Changes

We may update these terms. A material update bumps the in-app version and requires re-acceptance. Continued use after you accept the new version constitutes acceptance. The draft banner remains until lawyer review is recorded.

9. Billing and subscriptions

Paid access is a subscription. The prices on the subscribe buttons are the subscription prices.

Trial

New accounts receive a 14-day trial from signup. We do not collect a card during the trial and we do not charge during the trial. If the account is still unpaid after the trial end date, access continues for a 48-hour grace period. Starting a paid subscription during the trial or grace period starts the paid billing period.

Price

Stripe Tax is not enabled yet. If Stripe shows tax at checkout, that amount is displayed before you pay. Listed prices are not described as GST-inclusive.

Auto-renewal

Subscriptions renew automatically at the end of each billing period until you cancel. There is no extra notice period beyond the current period.

Cancel

You can cancel online in Settings via the Stripe Customer Portal. Cancel ends the subscription at the end of the current period. You keep access until that date. The current period is not refunded. There is no "change of mind" refund.

Delete account

Deleting your account immediately cancels any live Stripe subscription, with proration. The same immediate prorated cancel applies when a live solo subscription is dropped because household cover starts.

Household

The household is billed once, on the member whose entitlement holds the household plan. A partner is covered by that bill and does not pay a second subscription. Downgrade from household to solo happens only at period end, and only when the household no longer has two live members.

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law that cannot be excluded. Those non-excludable rights still apply.

10. Governing law
